Terms of Service

The agreement between you and Mon Élan.

These Terms govern your membership, your use of the Mon Élan platform, billing, cancellation, and dispute resolution. They do not govern clinical care directly — clinical relationships are governed by your Telehealth Consent and the standard of care for your treating clinician.

Plain-language summary

Mon Élan is a private clinical practice that does not bill commercial insurance, Medicare, or Medicaid for clinical services. You pay a flat monthly membership; we provide physician-led optimization care through telehealth. Pharmacies bill you separately for medication at the dispensing pharmacy's published cash price. Mon Élan does not add a markup to medication.

  • What you pay us: a monthly membership of $179 (Foundation), $349 (Optimize), or $699 (Concierge+), or — for organizational customers — an Enterprise tier billed at custom contract rates. You may change tiers at any time; tier changes apply at the start of the next billing cycle.
  • What we provide: physician video visits, unlimited secure messaging, lab review, protocol design, prescription routing, the patient portal, and Insights Program participation (opt-out anytime).
  • What we don't bill you for: medication. The dispensing pharmacy bills you directly at its published cash price. Mon Élan does not add a markup to medication.
  • Cancellation: any time, two taps, no minimum term, no save calls.
  • Disputes: we ask you to try direct resolution first; remaining disputes are resolved through individual arbitration. You can opt out of the arbitration clause within 30 days of joining.

What Mon Élan is, and is not

Mon Élan Medical, P.C. is a Texas professional corporation that provides physician-led lab-tracked-care care. Mon Élan MSO is the management services organization that operates the platform, brand, and billing relationships supporting Mon Élan Medical, P.C. Partner Professional Corporations may deliver additional programs under a Professional Services Agreement and Business Associate Agreement with Mon Élan MSO as those programs activate. No Partner PC services are active at launch. Together, "Mon Élan," "we," "us," and "our."

Mon Élan is not:

  • An emergency room. We do not provide emergency care.
  • A psychiatric crisis service. If you're in crisis, call or text 988 (Suicide & Crisis Lifeline) or 911 immediately.
  • An insurance plan or a payment service. We don't bill insurance. Your subscription is the product.
  • A pharmacy. Your medication is dispensed by a separate licensed pharmacy and billed by that pharmacy directly to you.
  • A primary-care practice. We don't replace your PCP; we complement them. Your physician will refer to in-person providers when your condition requires care outside our scope.

Who can be a member

  • You must be at least 18 years old. Mon Élan does not provide care to minors.
  • You must be a resident of a state in which Mon Élan is actively practicing at the time of your enrollment. Mon Élan is currently currently expanding nationwide; state-specific rules (such as in-person examination requirements for controlled substances) are confirmed by your prescribing physician at intake.
  • You must complete our intake assessment, including the Universal Safety Screen (PHQ-2, GAD-2, C-SSRS), and accept the terms of your Telehealth Consent.
  • Mon Élan reserves the right to decline enrollment when our clinicians judge that telehealth is not the appropriate setting for your care (red-pathway exclusion criteria as described in the Critical Safety Protocol). Declined patients receive a full refund of any payment.

Your membership and what's included

Your membership covers the following services from Mon Élan Medical, P.C. (and where indicated, our Partner PCs):

  • Physician relationship — 45-minute initial video visit, monthly video check-ins, unlimited secure messaging between visits.
  • Medication coordination — branded GLP-1 (Wegovy®, Zepbound®, Mounjaro®) is dispensed by a separately licensed retail/specialty pharmacy partner. 503A compounded peptide protocols are dispensed by a separately licensed 503A compounding pharmacy partner. See our Compounding Disclosure.
  • Lab review — your physician reviews labs you bring from your PCP or routes an order through a preferred laboratory at your visit. Mon Élan's integrated baseline panel activates once our lab partner network is fully online.
  • Personalized protocol — your physician designs a protocol integrating medication, peptide stack (where applicable), and adjuvant interventions.
  • Patient portal — scheduling, secure messaging, lab uploads, prescription tracking, billing, communication preferences.
  • Insights Program participation — you are enrolled by default; opt out at any time from your portal under Data & Privacy. Care is identical regardless of opt-status.

What's included evolves as new verticals activate. The features available at the time you joined remain available to you; additional verticals may have additional fees or activation details when they launch — we'll communicate any such addition by email at least 30 days before charging.

Pricing, billing, and refunds

Subscription pricing

  • Foundation — $179/month. Single-vertical optimization, quarterly clinical reviews, two lab panels per year, async messaging.
  • Optimize — $349/month. Multi-vertical coordination, monthly clinical reviews, four lab panels per year, full Patient Dashboard access.
  • Concierge+ — $699/month. Dedicated medical director, unlimited clinical touchpoints, custom-paneled labs, in-network specialist coordination.

Billing

  • Membership is billed monthly via Stripe to the payment method on file. Stripe is a PCI-DSS Level 1 payment processor; Mon Élan does not store your full card number.
  • Your billing cycle starts on the date of your first successful charge and renews monthly on that calendar day.
  • Failed payments trigger up to three retry attempts per Stripe's standard retry schedule. After the final failed retry, your access is paused; protocol-relevant prescription routing is paused until billing is current. Acute clinical safety messaging continues regardless.

Refunds

  • Red-pathway handoff. If your safety screen indicates active risk and Mon Élan completes a warm handoff to specialty care, you are not enrolled into Mon Élan treatment. Intake is free, so there is nothing to refund. If, in any other situation, a Mon Élan-affiliated physician determines you should not begin treatment after a charge has been processed, we refund any payment for that membership period in full immediately.
  • State-availability change at enrollment. If Mon Élan is unable to provide care in your state (you moved, a state is paused for licensing reasons, etc.) and we cannot accommodate within 30 days, we will refund unused membership days on a pro-rated basis.
  • Routine cancellation. By default, cancellation stops further billing but does not refund the current period. You retain access through the end of your paid period. Goodwill refunds for documented service failures are at Mon Élan's reasonable discretion.
  • Medication payments are not refundable by Mon Élan because Mon Élan never collected them — they were paid directly to the pharmacy. Pharmacy refund policies are governed by the pharmacy.

Medications are billed separately

Mon Élan does not include medication cost in your membership. The dispensing pharmacy bills you directly at its published cash price.

  • Branded GLP-1 (Wegovy®, Zepbound®, Mounjaro®) — dispensed by a separately licensed retail/specialty pharmacy partner at the dispensing pharmacy's published cash price. The exact figure for your visit appears in your portal before you authorize routing.
  • Compounded peptides — dispensed by a separately licensed 503A compounding pharmacy partner at the pharmacy's published cash price for compounded preparations. The full out-of-pocket cost is shown in your portal before any prescription is routed.
  • Mon Élan does not add a markup to medication and does not receive a percentage of the medication transaction. Our pharmacy relationships are governed by Business Associate Agreements (where PHI flows beyond the standard prescriber-pharmacy exchange) and arms-length commercial terms.

Cancellation and discontinuation

Cancel any time, two taps, no save calls, no minimum term, no surprise bills. This is canon at Mon Élan; we don't compete on lock-in.

Cancel from your portal under Settings → Billing. Your access remains through the end of your current paid period.

Clinical discontinuation protocol

If you are on a clinically active protocol when you cancel (peptide, GLP-1, etc.), your physician will offer a clinical discontinuation protocol — a taper plan, monitoring schedule, and where appropriate, a transition-of-care referral to support a safe handoff. You may decline; declination is captured as an Informed Refusal acknowledgment with documented risks. Your right to cancel is unaffected by whether you accept or decline the discontinuation protocol.

What we do not do

Mon Élan's cancel flow does not surface surprise discounts, MD "save" calls, dark patterns, or friction. If your cancellation experience does not match this commitment, please email support@monelan.co — we want to know.

Re-entry

You may re-enroll any time. Re-enrollment after a cancellation gap of 12 months or longer is at the then-current published pricing.

Termination by Mon Élan

Mon Élan may suspend or terminate your membership for material violation of these Terms (e.g., fraud, abusive treatment of staff, misrepresentation of identity), or where continuing care would be clinically inappropriate. We will refund the unused portion of your current paid period and, where applicable, provide a transition-of-care referral.

Your responsibilities as a member

  • Provide accurate information at intake and at every clinical encounter. Material misrepresentation may result in termination and is a basis for the Mon Élan clinician to decline ongoing prescribing.
  • Respond to clinical follow-ups (lab requests, monthly check-ins, safety questions) within reasonable timeframes. Persistent non-response may result in protocol pause and ultimately termination.
  • Do not share your portal credentials or allow another person to receive care under your account.
  • Do not use Mon Élan-prescribed medication for any person other than yourself, or in any way other than as prescribed.
  • Notify us if you relocate or travel before any video visit so we can route you to a clinician licensed in your current state of residence.
  • Treat Mon Élan staff and clinicians with the same professional respect you would expect in any clinical setting.

Use of the Mon Élan platform

The Mon Élan website, patient portal, and any associated applications (collectively, the "Platform") are provided to you as part of your membership. You agree:

  • Not to scrape, reverse-engineer, decompile, or attempt to extract proprietary content beyond what's needed for your personal clinical use.
  • Not to upload malware, attempt to access another patient's record, or otherwise interfere with platform integrity or availability.
  • That uploaded content (lab results, photos, messages) is your responsibility for accuracy and that you have the right to upload it. Mon Élan does not pre-screen uploaded content for accuracy or appropriateness.
  • That platform availability targets are SLA-best-effort, not guaranteed. Outages happen; we'll communicate them, work to resolve them, and accommodate clinically-relevant impacts on your care.

Intellectual property

The Mon Élan platform, brand, marks, written content, design, protocol templates, and proprietary clinical methodology are owned by Mon Élan MSO or used under license. Membership does not transfer ownership of any of this to you.

Your data is yours. Your protected health information, lab results, messages, and personal information belong to you. You may export your record at any time. The Platform retains licenses needed to deliver care to you and to comply with our retention obligations under HIPAA and state law.

De-identified aggregate data from the Insights Program (where you have not opted out) is owned by Mon Élan MSO for use in clinical-protocol refinement. The aggregate dataset is not provided to advertising or marketing networks. Any future commercial or research partnership for the aggregate dataset will be governed by a data use agreement. Per our Privacy Notice, we do not attempt to re-identify aggregate data and we do not allow third parties to do so.

Third-party services and pharmacies

Mon Élan integrates with third-party services to deliver your care. Each is governed by its own terms and privacy practices, and where the service receives PHI, by a Business Associate Agreement with Mon Élan:

  • Microsoft Azure — cloud infrastructure, telehealth video, identity. BAA executed with Microsoft.
  • Stripe — payment processing. PCI-DSS Level 1. Stripe does not receive clinical information.
  • 503A pharmacy partner (final selection per Cohen Healthcare Law diligence). Our partner both prepares 503A compounded peptide protocols AND retail-dispenses branded FDA-approved GLP-1 medications. It is a separately licensed pharmacy with its own commercial terms; you pay them directly for medication dispensed. Partner name and license details will be published once the partnership agreement is executed.
  • Laboratory partners for lab orders routed through your physician at your visit.

Mon Élan is not responsible for the acts or omissions of these third-party providers beyond our contractual oversight; they are independent entities with their own malpractice and product liability coverage.

Medical disclaimers and limitations

  • Care is not guaranteed to produce specific outcomes. Lab-tracked-care protocols vary in individual response. Your physician will set realistic expectations grounded in evidence; outcomes vary.
  • Compounded medications are not FDA-approved. See the full disclosure at /compounding-disclosure.
  • Supplements claims are not FDA-evaluated. Any supplement Mon Élan offers is governed by DSHEA structure-function disclaimer language; supplements are not intended to diagnose, treat, cure, or prevent any disease.
  • Telehealth has limits. See your Telehealth Consent for the full statement.
  • Marketing content is illustrative. Photos, testimonials, and case studies on our marketing pages are representative and may not reflect the average outcome. Where compensation was provided for a testimonial, it's disclosed.

Limitation of liability

To the fullest extent permitted by applicable law, and except for liabilities that cannot be limited by law (e.g., professional malpractice, gross negligence, willful misconduct, or any liability for personal injury caused by negligence as Texas law restricts):

  • Mon Élan MSO is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Platform.
  • Mon Élan MSO's aggregate liability for any claim arising out of or related to your membership or use of the Platform is limited to the membership fees you paid Mon Élan in the 12 months preceding the event giving rise to the claim.
  • The clinical-care liability of Mon Élan Medical, P.C. and our Partner PCs is governed by their respective professional malpractice insurance and applicable state professional-liability law. Nothing in these Terms limits clinical malpractice liability below the legally permitted floor.

Indemnification

You agree to indemnify and hold Mon Élan MSO, Mon Élan Medical, P.C., our Partner PCs, and our respective officers, employees, and contractors harmless from any claim, loss, or liability arising from: (a) your material breach of these Terms; (b) your willful misconduct or fraud; (c) your misuse of any medication prescribed to you (including using it for a person other than yourself or in a manner other than as prescribed); or (d) your violation of applicable law in connection with your Mon Élan membership.

Disputes, arbitration, and class waiver

Important: this section affects your legal rights. Read it carefully. You may opt out of the arbitration agreement within 30 days of joining Mon Élan by emailing legal@monelan.co with the subject "Opt out of arbitration" and your account email. Opting out does not affect any other Term.

Direct resolution first

Before any formal dispute, you agree to first contact us at legal@monelan.co with a written description of the issue. We will respond within 30 business days and work in good faith to resolve directly.

Arbitration of remaining disputes

Any dispute not resolved by direct discussion will be resolved by individual binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Travis County, Texas, or remotely by mutual agreement. Either party may seek provisional relief in court (e.g., a TRO) where necessary to preserve the status quo pending arbitration.

This is not the right forum for clinical malpractice claims, which are governed by Texas medical liability statutes and applicable state law. Nothing in this section waives, limits, or abridges the procedural protections of the Texas Medical Liability Act (or analogous state law) for malpractice claims against any clinician or professional corporation.

Class action waiver

You and Mon Élan agree that any dispute will be brought in your individual capacity, not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate claims or preside over any class or representative proceeding. If this class waiver is found unenforceable in whole or in part, the rest of the arbitration agreement remains enforceable to the extent legally permitted.

Small-claims exception

Either party may bring an individual claim in small-claims court instead of arbitration if the dispute qualifies under that court's monetary and subject-matter rules.

Jury trial waiver (where arbitration applies)

Where this section requires arbitration, you and Mon Élan waive the right to a jury trial.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement above.

Where you reside outside Texas, your state's consumer-protection laws may grant you rights that supplement these Terms. Nothing in these Terms reduces those rights below the legal floor.

Changes to these terms

We may update these Terms from time to time. The current version is always posted at monelan.co/terms with the effective date at the top.

Material changes (changes that affect your rights, obligations, or the price of your membership) will be communicated to active members by email at least 30 days before they take effect. Continuing to use Mon Élan after the effective date of a material change means you accept the revised Terms; if you do not accept, you may cancel your membership without penalty.

Non-material changes (clarifications, formatting, contact information) take effect on the date posted.
